Supplying South Africa
On state work here, responsiveness is tested before money. The DTIC stipulates minimum local content thresholds sector by sector; a bidder declares against them on form SBD 6.2, with the arithmetic under SATS 1286:2011. Valves and actuators are designated, as are pumps, medium-voltage motors, cables and transformers — and some designations are pitched at 100 per cent, against which imported product cannot be responsive at any price. Since a false declaration carries disqualification and debarment, the applicable designation is what a bidder reads first.
The 2024 statute fell away in September 2026
The Public Procurement Act 28 of 2024 is no longer law. Handing down [2026] ZACC 37 on 17 September 2026, the Constitutional Court struck it down in full as unconstitutional for want of facilitated public involvement, without suspending that order. No gap followed, the Act never having been brought into operation. What continues to govern is the PFMA, MFMA Chapter 11, the PPPFA 5 of 2000 and National Treasury instruction notes, so any briefing paper resting on the 2024 statute is out of date. Notices go up on eTenders, etenders.gov.za, and a bidder must be on the Central Supplier Database at secure.csd.gov.za.
Who the authority letter belongs to
Some 81 compulsory specifications are administered by the NRCS, each written against a product; machinery as a class has none. Where one catches the goods, clearance runs on a Letter of Authority held in the local importing entity's name. It cannot be issued to a manufacturer in China, so a seller cannot supply it. Care is needed around VC 8055, which reaches electrical and electronic apparatus rated to 600 V and below, reads as an open-ended list, and nowhere excludes industrial equipment. Whole machines are not, as matters stand, taken through it — but their panels, transformers, uninterruptible supplies, drives and inverters commonly are, and border disputes over scope are on record. Exemption should never be promised without a written NRCS ruling against the exact tariff code.
Vessels and refrigerant circuits follow labour law
Air receivers, pressure vessels and refrigeration circuits lie outside the NRCS entirely, dealt with by the Pressure Equipment Regulations, which reference SANS 347 and sit under the Occupational Health and Safety Act 85 of 1993 rather than standards law. A compressor or cold-room package therefore runs two approval routes at once, and both repay being opened early.
Second-hand content gates the shipment
Nothing used or second-hand enters without an ITAC permit, which is non-automatic: issue rests on whether an equivalent is made locally. Where part of an offer is refurbished, reconditioned or ex-demonstration, the permit sets the timetable and belongs in the contract as a condition precedent.
Corridors, congestion and sockets
Durban moves more containers than any port in sub-Saharan Africa and serves Botswana, Zimbabwe, Zambia and the DRC inland; Cape Town, Ngqura at Coega, Port Elizabeth and East London take the balance. Transnet congestion and equipment availability remain a live scheduling risk in 2026, so a delivery date wants float rather than a copied sailing schedule. Industry runs on 400 V three-phase at 50 Hz, single-phase at 230 V. The socket is the oddity: Type M under SANS 164-1, large round pins, is still the commonest fitting already installed, while wiring code SANS 10142-1 has obliged every new installation since January 2018 to provide at least one Type N point to SANS 164-2 at each socket position. Assume the former on existing plant, the latter in new build. Documents and correspondence are in English. No spares business or in-country service capability stands behind what we ship, and warranty, installation and training arise only from the contract.
