Food Processing Plants and Line in South Africa
On a South African state tender, local content is tested before price. The DTIC designates sectors with a stipulated minimum local content threshold, declared on SBD 6.2 and calculated per SATS 1286:2011. Designated items include valves and actuators, pumps and medium-voltage motors, cables and transformers, and some designations are set at 100 per cent local content, which makes imported product non-responsive regardless of price. A false SBD 6.2 declaration is grounds for disqualification and debarment, so read the designation covering the tendered items first.
Which procurement law applies
On 17 September 2026 the Constitutional Court declared the Public Procurement Act 28 of 2024 unconstitutional and invalid in its entirety ([2026] ZACC 37) for failure to facilitate public involvement, without suspending the invalidity. The Act had never been proclaimed into operation, so no legislative gap opened: the regime remains the PFMA, Chapter 11 of the MFMA, the PPPFA 5 of 2000 and Treasury instruction notes, and bid material citing the 2024 Act is out of date. Opportunities appear on eTenders at etenders.gov.za, with registration on the Central Supplier Database.
The Letter of Authority belongs to the importer
The NRCS administers about 81 compulsory specifications, all product-specific; none covers machinery as a class. Where one applies, the entry instrument is a Letter of Authority, which must be held by the South African importer rather than the Chinese manufacturer. VC 8055, covering electrical and electronic apparatus at or below 600 V, is worded "includes, but not limited to" with no express exclusion of industrial equipment. Complete machines are not LOA'd in practice, but control panels, transformers, UPS units and drives supplied with them routinely are, and out-of-scope border disputes are documented. No buyer should be told a machine is exempt without a written NRCS scope ruling for its HS code.
Pressure parts follow a separate statute
Pressure vessels, air receivers and refrigeration circuits sit outside the NRCS, under the Pressure Equipment Regulations made under the Occupational Health and Safety Act 85 of 1993, referencing SANS 347. A Food Cashew Pressure Steam Boiler therefore runs on a different approval track from the electrical content of the same line, and both are best progressed in parallel.
Anything not new, and site supply
Used or second-hand goods need a non-automatic ITAC import permit, granted by reference to whether equivalent South African production exists. If any part of an offer is refurbished, reconditioned or ex-demonstration, the permit gates the shipment. Durban, the largest container port in sub-Saharan Africa, is also the gateway for Botswana, Zimbabwe, Zambia and the DRC, with Cape Town, Ngqura, Port Elizabeth and East London alongside; Transnet congestion remains a live scheduling risk in 2026. Mains are 230 V with 400 V three-phase industrial supply at 50 Hz. Sockets are the unusual part: SANS 164-1 (Type M) remains the most common installed outlet, while since January 2018 SANS 10142-1 has required every socket point in a new installation to include at least one SANS 164-2 (Type N) outlet.
