Army Equipment in Malaysia
Route an order through Hong Kong and the Malaysian buyer can lose the ACFTA preference. MITI's position is that Hong Kong is not a party to the ASEAN-China Free Trade Area. Mainland-origin goods landed and reshipped there need a correct back-to-back certificate of origin and evidence of direct consignment, or the buyer pays the most-favoured-nation rate. Form E must demonstrate 40% regional value content and reach Malaysian Customs within four months of endorsement, extended to six months where the goods transited a non-party. MITI's own guidance is self-contradictory on third-party invoicing, so obtain a written ruling from the Royal Malaysian Customs Department before setting up triangular invoicing.
Thresholds exclude before anyone evaluates a bid
Federal supplies run through ePerolehan at home.eperolehan.gov.my under the Ministry of Finance, and the value bands decide who may take part at all:
- below RM20,000, no MOF registration is needed;
- RM20,000 to RM50,000, any registered local supplier;
- RM50,000 to RM100,000, registered Bumiputera companies only;
- RM100,000 to RM500,000, any registered local supplier, with a Bumiputera price preference;
- above RM500,000, open tender.
MOF registration in practice requires a locally registered entity, and Malaysia is a GPA observer, not a party, so no treaty route gets round this. A local partner is the structure, not an optional extra.
SIRIM approval is not the obstacle people expect
There is no pre-shipment verification of conformity programme. The Energy Commission's Certificate of Approval under the Electricity Supply Act 1990 covers 34 categories of domestic and low-voltage equipment normally sold to the general public, and the guideline explicitly excludes types promoted solely to industrial or commercial users. Said plainly: uniforms, footwear, anti-riot armour, suppression blankets, search kits and a door frame metal detector need no Certificate of Approval and no SIRIM label. Domestic-pattern plugs and cordage supplied with an item can be caught, and the application is the local importer's. Separately, the Factories and Machinery (Repeal) Act 2022 repealed the 1967 Act, moving fitness certificates and approvals to the Occupational Safety and Health Act 1994 regime under DOSH.
Protection claims deserve a plain answer
Enquiries here often ask for a bulletproof vest by name. The anti-riot armour in this range is described as stab resistant and shock resistant; it is not offered against a stated ballistic standard, and no protection level will be attached to it to win an enquiry. If a tender specifies a ballistic requirement, quote the clause and we will say whether it can be met.
Discharge import cargo at Port Klang — Westports or Northport, 14.64m TEU in 2024; Tanjung Pelepas ranks higher globally but is predominantly transhipment and is the wrong default for an import. Penang serves the north, Kuching and Kota Kinabalu East Malaysia. Single-phase supply is nominally 230 V at +10%/-6%, three-phase 400 V, 50 Hz within 1%, on Type G outlets. We do not trade spares or provide servicing; where installation, training or warranty is required it must be specified in the contract.
