Hand Tools and Machines in Vietnam
Since 1 July 2026 industrial machinery arriving in Vietnam has sat in the medium-risk tier, and medium risk means the declaration-of-conformity route rather than third-party type approval. Law 78/2025/QH15 and Decree 37/2026/ND-CP, in force from 23 January 2026, replaced the former Group 2 goods model with three risk tiers, and every ministry reissued its list from 1 July. The Ministry of Industry and Trade's Circular 33/2026/TT-BCT sets out six medium-risk groups, one being industrial machinery, equipment and materials, and lists nothing as high risk. Its appendices are HS-coded, so the useful thing a seller can hand over is the eight-digit code for each line, letting the importer check their own heading.
Form E pays, and is refused on paperwork
ACFTA preference is worth real money here, and Vietnamese customs is strict about its formalities. The schedule under Decree 118/2022/ND-CP covers 2022 to 2027, 11,459 tariff lines, average applied rate near 3.05 per cent. Four things have to hold: the line must be in the schedule, the goods of ACFTA-party origin, the direct-consignment rule satisfied, and Form E correctly issued. Third-party invoicing and a mismatch between the issuing authority and the named exporter are the usual grounds for rejection. Lose the form and the buyer pays MFN rather than zero to three per cent.
Adjacent lines follow different routes
Protective equipment in the same order takes a stricter path: Section I goods under Circular 01/2021/TT-BLDTBXH, such as dielectric gloves and footwear, face state quality inspection on import. Smart controls carry their own trap: under Circular 36/2026/TT-BKHCN radio modules appear on the risk lists, and Wi-Fi at 5 GHz or 6 GHz rated 60 mW EIRP or above is high risk, needing type approval as well as a declaration.
Labels, language and ports
Under Decree 43/2017, as amended by Decree 111/2021, imported goods must bear an original label with the compulsory content, plus a Vietnamese supplementary label before circulation — a packaging decision for the factory. Declarations are filed in Vietnamese through VNACCS/VCIS, and although English commercial papers pass in practice a certified translation may be demanded. Northern cargo routes through the Hai Phong complex and its deep-water Lach Huyen terminals, southern cargo through the Cai Mep-Thi Vai cluster; Cat Lai serves Ho Chi Minh City but is a river terminal with draft limits.
Buying and selling terms
Tenders fall under the Law on Bidding 22/2023/QH15 and the Ministry of Finance at muasamcong.mof.gov.vn — the address changed when Planning and Investment merged into Finance — and Vietnam is a GPA observer, not a party. Supply is 220/230 V single-phase, 380 V three-phase, 50 Hz, with hybrid Type A, B and C sockets. Reconditioned plant is age-capped under Decision 18/2019/QD-TTg, broadly ten years by sector. Sixteen lines make up this range, from hardened spanners and VDE pliers sets to a 180 mm angle grinder and electric planer. Nothing here includes spares or a service presence in-country; warranty, installation and training exist only if the contract provides them.
